1. The present appeal pertains to the year 1995. Notices were issued to the parties by the Registry. As per the Office report, the sole appellant has since expired. Notice issued to the respondent has not been received back served or otherwise. Today again neither anyone has appeared on behalf of the deceased appellant nor has any application been filed by his legal heirs for impleading them as parties.
2. In view thereof, this Court is left with no other option but to dismiss the present regular second appeal for non-prosecution.
3. Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
