1. The present petition is for grant of anticipatory bail to the petitioner in case FIR No.426 dated 07.10.2023 under Sections 323, 324, 341, 506 and 34 of IPC (Offence under Sections 326 and 201 of IPC added later on) and Section 379 of IPC deleted later on, registered at Police Station Gandhi Nagar, District Yamuna Nagar.
2. Mr. Kuldeep Sheoran, Advocate, for Mr. Sandeep Saini, Advocate, has put in appearance on behalf of the complainant and filed his power of attorney, which is taken on record.
3. After vehemently arguing on the merits of the case and since the Court was not inclined to grant the relief, the learned counsel for the petitioner prays for withdrawal of the present petition with liberty to surrender before the Court below and contains his prayer that the regular | attest to the accuracy and integrity of this Order/Judgment SANDEEP SETHI 2024.04.11 07:57 2024:PHHC:048015 CRM-M-16521-2024 bail, if any filed by the petitioner be decided expeditiously within one week and the petitioner should be granted parity with co-accused Pardeep Kumar.

In light of the above, the present petition stands disposed of without expressing any opinion on the merits of the case and the petitioner is directed to surrender before the Court below within one week from today and in case, he applies for grant of regular bail, the same be decided expeditiously, preferably within 10 days from the date of said application.
5. It is made clear that the observations made above shall not be looked into by the trial Court while deciding the regular bail of the petitioner and the same shall be decided on its own merits, in accordance with law.
6. However, in addition to the above, the State-authorities are directed to verify the correct position as to whether the complainant has tried to mislead and abuse the process of law or not.
