The appellants-defendants are in appeal against the judgment of reversal passed by the Additional District Judge, Patiala whereby the appeal against the judgment and decree dated 25.10.1989 passed by the Sub Judge, First Class, Samana has been allowed in part and the suit of the respondents-plaintiffs was decreed with regard to relief of permanent injunction to restrain the appellants-defendants from interfering with the possession of Balwant Singh- defendant/respondent No.4 forcibly except by due process of law.

There has been no appearance on behalf of the appellants on last three dates successively.

Notice was issued to the appellants whereupon an intimation was received that appellant No.1 refused to accept notice while appellant No.2 is reported to have died. Insofar as the appellant No.3 is concerned, he remains unserved on account of an incomplete address. It was noticed by this Court that there is no address available 1 of 2 ::: Downloaded on - 11-04-2024 04:34:03 ::: Neutral Citation No:=2024:PHHC:047984 RSA-1709-1992 -2- with the Court except the one given in the memo of parties. Hence, it seems that the appellant-defendant is no more interested in pursuing the present appeal.
