1. Vide order dated 28.11.2023 fresh notices were issued to the appellants. As per the office report, the appellant remains unserved due to incomplete address. This is the only address of the appellant which was given in the memo of parties as well as in the judgments and decrees of both the Courts. Respondent Nos.1 to 3, 5 and 6 are stated to have died. Respondent No.4 stands duly served, however, no one has put in appearance on his behalf.
2. No one has put in appearance on behalf of the appellant. In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution.
3. Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
