Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of certiorari, for setting-aside the order dated 14.09.2023 (Annexure P-11) passed by the respondents, vide which a punishment of 10% cut in pension of the petitioner for a period of 03 years has been imposed.
On the last date of hearing i.e. 18.03.2024, the following order was passed:-
"Learned counsel for the petitioner inter alia contends that the earlier writ petition filed by the petitioner impugning the punishment order and the Appellate Authority order was allowed vide judgment dated 18.04.2023 and both the orders were set-aside, however, liberty was granted to the respondents to proceed afresh in accordance with law. He submits that the impugned order has been passed by the Appellate Authority whereas the matter was required to be reconsidered by the disciplinary authority, after supplying the dissent note to the petitioner in accordance with law and in conformity with the principles of natural justice.

Learned counsel for the respondents has produced a memo dated 04.04.2024 whereby the impugned order dated 14.09.2023 has been withdrawn and the case has been remanded back to the punishing authority i.e. Director/Administration, to proceed afresh in accordance with law from the state of inquiry report.
In view of the above, the present petition has been rendered infructuous and the same is disposed of accordingly.
