ALKA SARIN, J. (ORAL)
1. The present appeal pertains to the year 1997. Vide order dated 12.12.2023 notices were issued to the parties. As per the service report, sole appellant was not found residing at the given address. Respondent No.1 was also not found residing at the given address. This is the only addresses which were given in the memo of parties and in the judgments and decrees passed by the Trial Court and the First Appellate Court. Respondents No.2 and 4 are stated to have died. Respondent No.3 refused to accept the notice, however, affixation has been made. Accordingly, he is deemed to having been served. No one has put in appearance on behalf of the appellant.
2. In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution.
3. Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
