Learned counsel for the appellant-UOI has submitted the affidavit, as sworn by Ms. Jyoti Batheja, Deputy Chief Commercial Manager/ Claims in Northern Railway along-with Annexure A-1, i.e the copy of the Receipt qua the payment of the amount of Rs.50,417/- through cheque, in compliance of the impugned judgment dated 19.10.2000, in the Court today and both these documents have been placed on the file. He seeks permission to withdraw the instant appeal, while submitting that the same has become infructuous in view of the payment of the above-said amount.

Resultantly, the Appeal in hand stands dismissed as withdrawn for having been rendered infructuous.
