Learned counsel for the petitioner very fairly submits that keeping in view the judgment of the Hon'ble Supreme Court of India in SLP (Civil) No.12441-2022 titled as Sudhir Singh and others vs. State of U.P. and others decided on 30.10.2023 which judgment has also been relied upon by this Court while passing order in CWP-20552-2022 titled as Lt Col. Manish Gupta and another vs. State of Haryana and another as the petitioner was in service on the date when he applied for the post in question, case of the petitioner is covered against him as per the settled principle of law.
Keeping in view the said fact, present petition is dismissed.
