1. The petitioner/complainant at whose instance FIR No.95, dated 27.10.2016, Police Station Sarabha Nagar, Ludhiana, under Sections 379, 420, 120-B IPC was lodged seeks issuance of directions to respondents No.4 and 5 i.e. the Assistant Commissioner of Police, West and Station House Officer concerned to take action on representation dated 20.09.2023 moved by the petitioner for conducting further investigation in the matter.

2. Status report by way of affidavit of Mr. Murad Jasvir Singh Gill, Assistant Comissioner of Police (West), Luhdiana has been filed. The same is taken on record. A copy of the short reply has been furnished to learned counsel opposite.

3. Having heard the learned counsel for the petitioner as well as the learned State counsel and bearing in mind the fact that as of today the police after concluding investigation has presented a cancellation report and even the MOHAN SINGH 2024.04.04 06:21 I attest to the accuracy and integrity of this order/judgment CRM-M-12399-2024 (O&M) -2- 2024:PHHC:044872 petitioner/complainant has also filed a protest petition, both of which are pending before the trial Court, this Court does not deem appropriate to issue any direction as prayed for. The petition, as such, is disposed of with a direction to the trial Court concerned to consider and dispose of the cancellation report as well as the protest petition in accordance with law. Needless to mention it shall be open to the trial Court concerned to pass appropriate orders in case it is of the opinion that the facts and circumstances warrant that further investigation is required or to take any other course in accordance with law.
