1. The present appeal has been filed against the judgment and decree dated 06.01.1992 passed by the Court of learned Sub Judge Class-III, Ferozepur whereby the suit for declaration preferred by the plaintiff/respondent has been decreed and the judgment dated 17.08.1993 passed by the Court of learned Additional District Judge, Ferozepur whereby the appeal preferred by the appellant/defendant has been dismissed.
2. Learned State counsel, on instructions from Sh. Gurdev Singh, Jr. Assistant O/o District Education Officer, Fazilka, submits that the sole respondent has retired on 30.11.1994 and thereafter, he died on 09.02.2006, however, his LRs have not been brought on record.
3. The claim raised by the respondent/plaintiff before the Courts below is with regard to regularization of his services w.e.f. 01.01.1973 instead of 01.01.1980. The execution of the decree passed by the Courts below has been stayed by this Court vide order dated 01.09.1997.
4. Accordingly, the present appeal is disposed of with liberty to the LRs of sole-respondent-deceased to revive the present appeal, in case anything still survives.
