1. Vide order dated 06.12.2023, notice was issued to the appellant as well as the respondents. As per office report the appellant stands duly served. Respondent Nos.1 and 2 stand duly served, however, respondent Nos.3 and 4 remain unserved with the report that they have left the house long ago.
2. Ms. Kompal, Advocate has put in appearance on behalf of the appellant. She, however, states that she does not have her instructions nor does she have the vakalatnama and she has been orally instructed to state that the appellant is unwell and would contact as and when he recovers.
3. The present appeal pertains to the year 1996 and there is no occasion for this Court to wait for the appellant any further. In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution.
