1. The present appeal pertains to the year 1996. Vide order dated 06.12.2023 notice was issued to the appellant as learned counsel appearing on behalf of the appellant had stated that he was unable to establish contact with the appellant.

2. As per the Office report, notice issued to the appellant has been received back unserved with the report that the appellant-company has shut down long ago. There is no other address available with the Court for effecting service of the appellant except the one mentioned in the memo of parties and in the judgments and decrees passed by the Trial Court and the First Appellate Court and is the same on which the notice was sent. Today again learned counsel for the appellant states that he has not been able to establish contact with the appellant.

3. In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution.

4. Dismissed for non-prosecution with liberty to revive in case anything survives. Pending applications, if any, also stand disposed off.
