Present application has been filed under Section 378 (4) Cr.P.C. seeking leave to appeal against the impugned judgment dated 09.10.2015, passed by learned Judicial Magistrate 1st Class, Ambala, vide which respondent has been acquitted from the allegations leveled against him by granting benefit of doubt.

(2) Allegations are that applicant/appellant, in view of the old family relations, advanced an amount of Rs.2,40,000/- in cash to the respondent; but he did not repay the same. Also alleged that respondent issued cheque bearing No.950601 dated 28.02.2013, amounting to Rs.2,40,000/-, which was dishonoured.
