Lakhvir Singh and ors ..Petitioners
Versus
State of Punjab and anr ..Respondents
CORAM: HON'BLE MR. JUSTICE AMAN CHAUDHARY
Present: Mr. Shreesh Kakkar, Advocate for the petitioners.
***
AMAN CHAUDHARY, J (Oral)
1. The prayer in the present Civil Writ Petition filed under Article 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus directing the respondents to grant the minimum of the pay scale from the date of their initial appointment on contract basis till the regularization of their services.
2. Learned counsel would contend that petitioners have not been accorded minimum of the pay scale from the date of initial appointments on contract basis till their services were regularized as Rural Associate Teacher and are still being paid the consolidated amount of Rs.6500/- per month which is even lesser than DC rate, while the similarly situated persons have been granted the same. He places reliance upon State of Punjab vs. Jagjit Singh, 2016(4) SCT 641, Harvinder Singh and others vs. State of Punjab and others, CWP-2031- 2016, decided on 21.01.2020 and Baljinder Kumar and others vs. State of Punjab and another, CWP-12583-2020, decided on 07.02.2024. In this regard, a legal notice dated 06.02.2024 (Annexure P12), has been served upon the respondents, which has yet not evoked any response. He thus, at this stage, on instructions, submits that the petitioners are sanguine of it being considered in a positive manner, in case, a direction is given to the respondents to decide the same in a time bound manner by granting them an opportunity of hearing.
3. Notice of motion.
