1 The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents No. 3 and 4 to take him to the office of respondent No. 2 for completing necessary formalities for issuance of passport.
2. Mr. R.S.Hooda, Advocate, contends that petitioner was implicated in FIR No. 45 dated 27.06.2017, under Sections 8, 21 and 29 of Narcotic Drugs and Psychotropic Substances Act, 1985, registered at Police Station NCB Zonal Unit Chandigarh. He was convicted vide judgment dated 06.12.2019 passed by learned Special Court, Chandigarh and awarded sentence of 10 years. He filed CRA-S- 460-SB of 2020 before this Court which stands admitted. The petitioner lost his passport and on the earlier occasion, he filed CWP- 10000 of 2023 before this Court seeking direction to respondents to re-issue him passport. The said petition, in the wake of statement made by both sides, was disposed of vide order dated 06.09.2023. The petitioner was given wrong impression that passport has already been issued whereas it was not issued.
3. Mr. Viran Jeet Singh Mahal, Advocate for UT, Chandigarh submits that police authorities would take the petitioner away to the office of Nigerian Embassy on 09.04.2024.
4. Faced with this, counsel for the petitioner submits that petition may be disposed of.
5. In the wake of statement of both sides, the petition stands disposed of.
