By way of present revision the petitioner has challenged order dated 01.11.2023 passed by Additional Sessions Judge, Ambala accepting the revision petition partly filed by respondent No.2/complainant against order dated 07.05.2018 passed by Judicial Magistrate First Class, Naraingarh.
After arguing for some time, counsel for the petitioner prays for permission to withdraw this revision petition. However, points out that in terms of the directions passed by Additional Sessions Judge, Ambala in the impugned order the petitioner was to appear before the Trial Court today i.e. on 28.11.2023.
Without commenting anything on merits of the case, the impugned order dated 01.11.2023 is modified only to the extent that the Trial Court shall adjourn the matter from 28.11.2023 without insisting upon the presence of the petitioner to 08.12.2023 i.e. when petitioner shall appear in compliance of directions in the impugned order.
Petition stands dismissed as withdrawn.
