This is a petition for initiation of contempt proceedings against the respondents, and directing the respondents to comply with the direction issued by this Court in CWP-16275-2018, vide judgment dated 25.03.2019.
Perusal of the order qua which the contempt is claimed by the petitioners shows that the respondent/State was directed to consider making a reference under Section 17 (2) of the Industrial Disputes Act, 1947 and the Labour Court was directed to decide the same preferably within six months. It is not even disputed by learned counsel for the petitioners that the matter of making the reference, as directed by the Writ Court, was duly considered by the respondent/State and the reference was made to the Labour Court. Not only that, the Labour Court has already disposed of the reference, vide order dated 15.11.2023. If the petitioners are aggrieved against any finding, judicial approach or mis-appreciation of material on record, the petitioners would be at liberty to challenge the same in appropriate proceedings. However, the initiation of contempt proceedings in the matter would not be the appropriate course of action.
