(ORAL) Learned senior counsel for the respective parties conceded the fact that the objection petition under Section 34 of the Arbitration and Conciliation Act, 1996 filed by the petitioner against the award dated 14.01.2022 has already been heard by the Additional District Judge, SAS Nagar, Mohali and the orders were reserved in the month of July, 2023 and the next date given for pronouncement of the judgment is 14.08.2023.
Keeping in view the said fact, once the main objection petition filed by the petitioner under Section 34 of the Arbitration and Conciliation Act, 1996 has already been heard and the orders have been reserved, passing of any order by this Court, at this stage, qua any interim order passed during the pendency of the petition filed under Section 34, will serve no purpose especially when status of 1 of 2 ::: Downloaded on - 12-08-2023 06:17:27 ::: Neutral Citation No:=2023:PHHC:104222 C.R. No.3178 of 2023 (O&M) -2- 2023:PHHC:104222 the main petition is for pronouncement of the order on 14.08.2023, and the next date of hearing in the execution petition filed by respondent No.1 is 31.08.2023.
In the interest of justice so that the parties do not suffer any prejudice, the Court, which has heard the objection petition filed by the petitioner under Section 34 of the Arbitration and Conciliation Act, 1996 and has already reserved the order in the month of July, 2023, and has fixed 14.08.2023 for pronouncement of the order, is requested to pronounce the final order by the next date fixed or before 29.08.2023 so that the parties could avail appropriate remedy, which they deem fit.
The present petition is disposed of with the above direction.
