The petitioner seeks regular bail in case FIR No. 265 dated 13.12.2022, registered at Police Station Alewa, District Jind, Haryana under Sections 420, 467, 468, 471 IPC and Sections 15(2) and 15(3) of IMC Act, 1956.

Learned counsel for the petitioner submits that the aforementioned FIR was registered because allegedly an illegal Laboratory had been set up. The doctor who had set up the said Laboratory has been granted anticipatory bail by this Court. The petitioner was only a class IV employee in the said Laboratory. The petitioner has already undergone custody in excess of 4 months and there is no other criminal case pending against him. The trial is not likely to be concluded at an early date as charges have not yet been framed. Thus, the petitioner may be granted regular bail.

Learned State counsel concedes that charges have yet not been framed.

It is, thus, evident that the trial is not likely to be concluded at an early date. Keeping in view the period of custody undergone as well as the fact that the petitioner was only a class IV employee in the illegal Laboratory, I deem it appropriate to grant regular bail to him. The petition is allowed and the petitioner is directed to be released on bail on his furnishing bail and surety bonds to the satisfaction of the trial Court/Duty Magistrate, concerned.
