MANOJ BAJAJ, J.(Oral) Appellants (defendants) have filed this regular second appeal to challenge the judgment and decree dated 11.09.2019 passed by Additional District Judge, Kurukshetra in Civil Appeal No.455 of 2018, thereby affirming the judgment and decree dated 30.11.2018 passed by Civil Judge, (Junior Division), Pehowa in Civil Suit No.37 of 2018, whereby the suit for mandatory and permanent injunction restraining them from raising construction over suit land, was decreed.
Though the appeal was filed on 19.09.2019 and the same was taken up for the hearing on 23.09.2019, but on request the case was adjourned to 01.10.2019. Ever since the filing of this appeal, consistently only requests for adjournment have been made. Today again, the counsel, who filed the appeal is not present.
The above background shows complete lack of interest in this appeal.
Dismissed for non-prosecution.
