Present petition is filed by Sachin Katyal, who was complainant and instituted a complaint case under Section 138 of the Negotiable Instruments Act, 1881 read with Section 420 IPC in the Court of learned Judicial Magistrate Ist Class, Chandigarh. Vide judgment dated 08.06.2017 (Annexure P-1), learned trial Court convicted and sentenced respondent/accused - Gurinder Singh. He was granted bail under Section 389 Cr.P.C. for filing appeal. Respondent/accused - Gurinder Singh preferred Criminal Appeal No. 407 of 2017, which is still pending.

Learned counsel for the petitioner submits that, in fact, respondent/accused - Gurinder Singh is enjoying the benefit of bail and not interested in early disposal of the appeal filed by him. Learned counsel further submits that petitioner would be satisfied if learned Appellate Court is directed to dispose of the aforementioned appeal expeditiously in a time bound manner.

Since the prayer made by the petitioner is limited to the extent of seeking direction for deciding pending appeal, present petition is disposed of by directing learned Appellate Court to look into the matter and make all possible efforts to decide pending appeal, i.e. Criminal Appeal No. 407 of 2017, titled as "Gurinder Singh v. Sachin Kumar", at the earliest, preferably within six months.
