1. This is a petition that has been filed under Article 226 of the Constitution of India for issuance of a writ in the nature of mandamus, directing the respondents to grant the seniority as per merit in the batch, pay fixation, arrears of salary, allowances and notional consequential benefits along with interest @15% per annum to the petitioners, who are posted as Constables, in terms of judgment passed by this High Court in CWP No.23644 of 2021 decided on 23.11.2021 and the speaking order dated 02.03.2022 passed by Senior Superintendent of Police, Sri Muktsar Sahib.
2. Learned counsel for the petitioners would contend that the petitioners have served legal notice dated 23.12.2022 (Annexure P-5) to respondent No.2, however, no decision has been taken thereon till date. It is further contended that the petitioners would be satisfied if a direction is issued to the respondent No.2 to consider and decide the legal notice given by them in a stipulated period.

4. Mr. C.L. Pawar, Sr. DAG, Punjab, who is present through the medium of video conferencing, accepts notice for the respondents and submits that respondent No.2 will look into the matter and will take a decision on legal notice given by the petitioners. Let sufficient number of copies of the complete paper book be supplied to respondent-State during the course of day.

Without commenting on merits of the case, I dispose of the instant petition by directing respondent No.2 to take a decision on the legal notice (Annexures P-5) of the petitioners in accordance with law within a period of one month from the date of receipt of certified copy of this order, failing which the officer responsible for the lapse would be liable to deposit costs of Rs.20,000/- from his personal pocket with the Punjab and Haryana High Court Advocates Welfare Fund.
