Learned counsel for the appellant has come up with the plea against the judgment dated 07.10.2021 whereby an ex parte decree of divorce has been granted to the wife. Learned counsel for the appellant seeks to avail the remedy of setting aside the ex parte divorce decree before the Family Court. Therefore, he seeks to withdraw this appeal at this stage with liberty to approach Family Court.
Dismissed as withdrawn with liberty aforesaid.
