Challenge in the present petition is to the judgment dated 1.12.2021/2.12.2021 vide which the learned Judge, Special Court, Chandigarh, has convicted the accused-appellant under Section 22 (C) of the Narcotic Drugs and Psychotropic Substances Act, and has sentenced the accused-appellant to undergo rigorous imprisonment for a period of 10 years and also directed the appellant to pay a fine of Rs.1 lac and on default of payment of fine to further undergo rigorous imprisonment for a period of one year for the offence under Section 22 (C) of the NDPS Act.

As per office report, the present appellant had also filed Criminal Appeal number CRA-S-91 of 2022 which was admitted vide order 1 1 of 2 ::: Downloaded on - 03-06-2022 23:00:56 ::: CRA-S-152-2022 (O&M) dated 20.1.2022 passed by a Coordinate Bench of this Court and the recovery of fine was stayed. Thus, the present second appeal filed by the same appellant is a duplicate appeal and deserves to be dismissed on the said ground. Liberty, however, is granted to the appellant to pursue Criminal Appeal bearing number CRA-S-91 of 2022 and the order passed in the present case would not come in the way of the present appellant agitating the points available to the appellant in CRA-S-91 of 2022.

Accordingly, the present appeal is dismissed with the above said observations.
