CR-3963- 2017 (O&M) Rashmi Chhabra ...Petitioner versus Vijay Kumar and another ...Respondents CORAM: HON'BLE MR. JUSTICE ANIL KSHETARPAL Present: Mr. Sandeep Arora, Advocate, for the petitioner Mr. A.S.Gill, Advocate, for the respondents.
ANIL KSHETARPAL, J (Oral) These two revision petitions have been filed challenging the identical orders passed in two different suits filed by the petitioners. In both the revision petitions, the parties are husband and wife.
They have claimed a definite amount in their respective suits as damages. The trial court has directed the plaintiffs, in the respective suits, to make up deficiency of the court fee as ad-valorem court fee is payable.
In view of the judgment passed by the Supreme Court in State of Punjab and others vs. Dev Brat Sharma, (Civil Appeal No(s).2064 of 2022(arising out of SLP (Civil) No.(s) 12468 of 2018, decided on 16.03.2022), the courts have correctly ordered payment of the ad-valorem court fee, particularly when the amount claimed has been quantified and specified.
