During jail inspection by the then Administrative Judge, Ambala Sessions Division, the petitioner-Janardan s/o Dharampal along with some other convicts had submitted applications to the then Administrative Judge seeking their premature release which were ordered to be put up on judicial side.
Vide judgment dated 24.02.1996 passed by learned Additional Sessions Judge, Jagadhri, the petitioner was convicted in case FIR No.245 dated 10.08.1991 registered under Sections 395, 396, 397 and 460 of the Indian Penal Code, 1860 at Police Station Jagadhri and sentenced to undergo rigorous imprisonment for life and today fine of Rs.1200/- and in case of default of payment of fine to further undergo rigorous imprisonment for 01 year.
Vide order dated 09.12.2019, learned State counsel was directed to apprise this Court as regards the current status of the sentence undergone by the petitioner.
1 of 2 ::: Downloaded on - 15-07-2022 18:48:33 ::: CRWP-1792-2019 -2- Reply by way of affidavit dated 16.02.2022 of Amit Kumar, Superintendent of Prison, District Prison, Karnal on behalf of the respondent-State has been filed by learned State Counsel in the Court today which is taken on record. Para 5 of the reply is reproduced as under:-
"5. That, the convict/petitioner was detained in case FIR No.07 dated 06.01.2005 U/s 8/9 of Haryana Good Conduct Prisoners (Temporary Release) Act, 1988 Police Station Baldev Nagar, Ambala after released on 31.10.2017 on prematurely in case FIR No.245 dated 10.08.1991 U/s 395/396/397 IPC P.S. Jagadhri. Hence, the petitioner/convict was finally released from District Prison, Karnal on 01.02.2018 after expiry of two (02) years Simple Imprisonment sentence in FIR No.07 dated 06.01.2005 U/s 8/9 of Haryana Good Conduct Prisoners (Temporary Release) Act, 1988 Police Station Baldev Nagar, Ambala. Presently the petitioner/convict is not confined in District Jail, Karnal."
In view of above, no further directions are required to be given in the present case and the same is disposed of accordingly.
