This is a petition that has been filed under Article 226 of the Constitution of India seeking issuance of a writ in the nature of mandamus, directing the respondents to consider the case of the petitioners and to pay them full salary including all admissible allowances during their probation period of three years service after appointment and the period spent on the probation be treated as a time spent on such post, in view of judgment passed by this Court in CWP No.6391 of 2016, titled as Dr. Vishavdeep Singh and others versus Stat of Punjab and others, decided on 26.10.2018, whereby the similar situated employees have already been granted the aforesaid benefit and further to grant them all arrears of pay and consequential benefits along with interest @ 12% per annum.
1 of 2 ::: Downloaded on - 06-12-2022 07:53:51 ::: CWP-27924-2022 -2- At this stage, counsel for the petitioners limits his prayer to the extent that the legal notice dated 24.05.2022 (Annexure P-8), served upon the respondents should be decided expeditiously. He would submit that the petitioners would be satisfied in case the said legal notice is decided in a time bound manner.

Mr. Mohit Kapoor, Addl. A. G., Punjab, who is also present in Court, accepts notice for the respondents and submits that the respondents will look into the matter and will take a decision on the legal notice of the petitioners. Let sufficient number of copies of the complete paper-book be supplied to him, during the course of the day.
Without commenting on merits of the case, the present petition is disposed of with a direction to the respondents to decide the legal notice dated 24.05.2022 (Annexure P-8) of the petitioners, within a period of four months from the date of receipt of the certified copy of this order, in accordance with law and convey the decision to the petitioners. In case of failure to do so, the official responsible for the lapse would be liable to costs of Rs.20,000/- from his personal pocket, to be deposited with the Punjab and Haryana High Court Advocates Welfare Fund.
