RITU BAHRI, J. (oral) This appeal has been filed by the appellant against the judgment and decree dated 06.10.2017 passed by the Additional District Judge, Ludhiana whereby the petition seeking decree of nullity of marriage, filed by the appellant under Section 12 of the Hindu Marriage Act, 1955 has been dismissed.

Vide order dated 13.07.2022, the parties were directed by this Court to appear before the Mediation and Conciliation Centre of this Court.

As per report of the Mediator dated 16.11.2022, the parties have amicably resolved their dispute and a settlement/agreement has been reduced in writing on 16.11.2022.

As per the settlement/agreement, appellant-Ashwani Bansal agreed to pay a total amount of `12,00,000/- towards permanent alimony (past, present and future maintenance). Out of which `4,00,000/- had been paid 1 of 2 ::: Downloaded on - 27-12-2022 03:12:01 ::: FAO-M-36-2018 -2- to the respondent-Kamaljit Kaur by way of cheque bearing No.944299 dated 16.11.2022 in her favour. Statements of the parties to this effect have been recorded today in Court.

As per the statements made by the parties, the appellant-Ashwani Bansal has accepted to pay total amount `12,00,000/-, towards permanent alimony (past, present and future maintenance). Out of which `4,00,000/- had been paid on 16.11.2022 by way of cheque in favour of respondent-Kamaljit Kaur. Today, again a demand draft amounting `8,00,000/-, has been handed over to the respondent in the Court. The parties undertake not to file any case against each-other and their family members in future. The respondent states that she has no objection if the appeal is allowed.

In view of the abovesaid settlement/agreement and statements made by the parties, the instant appeal is allowed and judgment and decree dated 06.10.2017 passed by the Additional District Judge, Ludhiana is set aside. Decree of divorce is granted to the parties. Decree sheet be prepared.
