Prayer in this petition is for grant of anticipatory bail in FIR No.60 dated 18.04.2016 under Sections 420, 120-B IPC and Section 13 of Punjab Prevention of Human Smuggling Act, registered at Police Station Cantonment, Amritsar.
Learned counsel for the petitioner relies upon the judgment dated 04.02.2020 passed by the trial Court, vide which co-accused of the petitioner, namely Rachpal Singh, who faced the full length trial, was acquitted. It is 1 of 2 ::: Downloaded on - 25-10-2021 21:02:16 ::: In virtual Court CRM-M-43441-2021 -2- submitted that allegations against the petitioner are identical in nature and while acquitting the aforesaid co-accused, the trial Court has recorded a specific finding that the prosecution has miserably failed to prove the allegations beyond doubt. It is also submitted that the petitioner is ready to face the trial.
Learned State counsel, on instructions from ASI Raj Kumar, submits that the petitioner was never declared a proclaimed offender in the present FIR. It is not disputed that though the complainants allege that they had made payment to petitioner Inderjeet Singh and co-accused Rachpal Singh, however, he already stands acquitted.
After hearing learned counsel for the parties and considering the aforesaid submissions, this petition is allowed and the petitioner is granted the concession of anticipatory bail subject to the conditions envisaged under Section 438 (2) Cr.P.C.
It is made clear that if the petitioner is required in the investigation, the Investigating Officer will issue him an advance notice in writing.
