Learned counsel for the petitioner does not dispute that the decree for possession by way of specific performance of the agreement to sell passed on 13.08.2012 has become final.
This revision petition has been filed by the judgment debtor against the order by which his objection petition was dismissed and warrants of possession were issued. Learned counsel submits that decree holder had previously filed an execution petition which was withdrawn on 17.10.2016 after he allegedly settled the matter with Gurdev Singh, the father of the judgment debtor. Learned Executing Court has found that there is no settlement as alleged by the judgment debtor. Gurdev Singh filed an application for being impleaded as a party in the execution petition which was dismissed. Still further, the judgment debtor filed an application for setting aside the ex parte decree which was again dismissed. Even an appeal against the same was filed but has been dismissed.
In view thereof, no ground to interfere is made out. Dismissed.
