2. Learned counsel appearing on behalf of the petitioner submits that the earned leave to which the petitioner Patna High Court CWJC No.7438 of 2023 dt.21-08-2023 2/2 was entitled for has been paid, however, he is entitled for dues interest for delay of nine year in making payment of the dues amount to the petitioner in light of the judgment passed by the Apex Court in case of State of Kerala vs. M. Padmanabhan Nair reported in (1985) 1 SCC 429 and D.D. Tewari vs. Uttar Haryana Bijli reported in (2014) 8 SCC 894 and another decisions of this Court.
3. Considering the aforesaid submission made on behalf of the petitioner, the Civil Surgeon, Katihar, is directed to make payment of interest and other retiral dues, if any, to which the petitioner is entitled for within a period of four weeks from the date of filing of the representation in accordance with law.
4. Accordingly, the present writ petition is disposed of.
