Order No. 11.09.2025 01.
Petitioner, who retired as the Headmaster of a Government School is grieving against non-consideration of his representation dated 25.11.2024, a copy whereof avails at Annexure-1, wherein he has sought for extension of a particular Pay Scale with effect from 01.12.1991 till his date of superannuation in the light of a Coordinate Bench decision in WPC(OAC) No.3264 of 2017 between Rama Chandra Sahoo v. State of Odisha and others, disposed of on 17.08.2022.
2. He also notifies to the Court that the said judgment was carried forward to the Apex Court of the Country in SLP(C) No.8528 of 2024 disposed of on 08.04.2024. He submits that if a direction is issued for consideration of the subject represent in accordance with law and in the light of the aforesaid decision, his client would be satisfied.
3. Learned AGA-Mr. Behura, accepting notice for the OPs very fairly submits that he would instruct OP No.1 to look into the grievance of the petitioner, as has been aired in the subject Page 1 of 2 representation in the light of recommendation made by the officials of the department favoring the employees like the petitioner, in a time bound way and in accordance with law, keeping in view the decision cited. With this proposal, petitioner's counsel is agreeable.
4. In the above circumstances, writ petition is disposed off fixing a period of eight (8) weeks for taking the decision in the matter and to inform the decision taken to the petitioner in writing. All contentions are kept open.
It is open to the answering OP to solicit any information or document from side of the petitioner, as are required for due consideration of the subject representation: however, subject to the rider that in that guise the delay shall not be brooked.
At this stage, no costs.
