01. W.P.(C) No.30759 of 2025

1. The matter is taken up through Hybrid Mode.

2. The points involved in the instant writ petition relates to the competency of the authority to impose transportation fees per quintal for movement of the Mahua flower from the store to a destination.

3. According to the learned counsel for the petitioner, the said point was also the subject matter of dispute in W.P.(C) No.14493 of 2004 and a Division Bench has already decided the same upholding the contention of the petitioner therein.

4. The counsel for the State submits that she needs some instruction from the competent authority as to the development having taken place after said judgment is delivered. She thus prays for an accommodation.

5. List this matter on 12th December, 2025 along with W.P.(C) No.8600 of 2025.

6. We thus found a prima facie case having made out, there shall be stay of the demand in Annexure-7 till the next date of hearing.

7. An urgent certified copy of this order be granted on proper application.
