[1] Captioned Miscellaneous case (MC) has been filed with a Condonation of Delay (CoD) prayer qua 216 days delay in filing an intra-court appeal assailing an order dated 27.05.2025 made by Hon'ble Single Judge in WP(C)No.666 of 2018 (Impugned order). [2] Learned State counsel, Mr. W. Niranjit submits that the impugned order is a service matter, there is no cap qua limitation, consequently Section 5 of the Limitation Act would apply and further submits that sub-paragraph A to F of paragraph 4 explains the manner in which delay occurred. Learned State counsel further submits that the delay is neither willful nor wanton. [3] To be noted, from a perusal of afore-referred sub paragraphs of paragraph 4 of CoD petition, it comes to light that 2 according to the State counsel, delay appears to have occurred owing to time consumed at various stages qua deciding, drafting and filing captioned appeal.

[4] Issue notice to all the 27(twenty seven) respondents returnable by 10.03.2026. Dasti permitted.
