By way of MC (WA) No. 183 of 2022, third parties to WP (C) No. 151 of 2021 seek leave to file an appeal against the common judgment and order dated 11.10.2022 passed by a learned Judge of this Court, in so far as it pertains to the said WP (C) No. 151 of 2021.

Heard Mr. K. Roshan, learned counsel for the applicants; Mr. A. Mohendro, learned counsel for respondent No. 6; Mr. Th. Tolpishak, learned counsel for respondent No. 5; Mr. I. Denning, learned counsel for respondent No. 4; Mr. RS. Reisang, learned senior counsel for the MPSC; and Mr. Athouba Khaidem, learned Government Advocate, appearing for the State authorities.

The common judgment and order dated 11.10.2022 pertained to three cases, viz., WP (C) No. 40 of 2021, WP (C) No. 41 of 2021 and WP (C) No. 151 of 2021. Significantly, the applicants who are now seeking leave are the petitioners in WP (C) No. 40 of 2021 and WP (C) No. 41 of 2021, whose writ petitions were Page 1 dismissed by way of the common judgment and order. Only WP (C) No. 151 of 2021 was allowed.

The very fact that the three cases were clubbed together for joint hearing and disposal indicates the commonality in the proceedings. That being so, the petitioners in WP (C) No. 40 of 2021 and WP (C) No. 41 of 2021 clearly have an interest in the third writ petition which was heard along with their cases.

Leave is accordingly granted as prayed for. MC (WA) No. 183 of 2022 is ordered.

Registry is directed to number the appeal, if it is otherwise found to be in order, and list the same for admission along with the W.A. No. 111 of 2022 and W.A. No. 112 of 2022 on 18.11.2022.
