                                                   JUDGMENT

(Judgment of the Court was made by R.SURESH KUMAR, J.) Mr.V.Balasubramani, learned counsel appearing for the appellant wants to withdraw this appeal in the SR stage itself with liberty to approach the appropriate Court (Family Court) to file a regular O.P. under the provisions of the Act to seek divorce against the respondent wife under any available grounds as fresh litigation.

2. Recording the same, this civil miscellaneous appeal stands dismissed as withdrawn at the SR stage itself and the Registry is directed to return back the originals, if any retained in the bundle, after retaining a photocopy of the same after getting acknowledgment of the learned counsel appearing for the appellant.

There shall be no order as to costs.
