                                                          JUDGMENT

Today, when the matter is taken up for hearing, the learned counsel on both sides have entered appearance and presented a Memo of Compromise, dated 23.08.2024 entered between the appellant/plaintiff and the 8th defendant/1st respondent.

2. Originally, the appellant filed a suit seeking for permanent injunction against the respondents from interfering with peaceful possession and enjoyment of the suit Schedule property. Subsequently, the defendants No.3 to 6 have given up in this Second Appeal. Since enjoyment of the suit Schedule property is in dispute and now both the plaintiff and the 8th defendant have agreed to share the property as described in the Memorandum of Compromise and enjoy the same without any dispute, the same is recorded. The Memorandum of Compromise, dated 23.08.2024 and the Sketch attached shall form part of the Judgment. 2/4 https://www.mhc.tn.gov.in/judis S.A.No.570 of 2012

3. Accordingly, the Second Appeal is allowed in terms of Memorandum of Compromise entered between the parties. No costs. Consequently, connected Miscellaneous Petition is closed.
