JUDGMENT

The respondents were the teachers and for having acquired higher qualification, since they are entitled to get additional incentive increment which they sought for and the same since had not been granted, they have approached the writ Court by filing a writ petition in W.P(MD).No.960 of 2011 where a learned Single Judge of this Court, having considered the case, passed final order on 16.04.2012 allowing those writ petition directing the respondents therein who are the appellants herein for grant of such incentive increment to the teachers concerned. Aggrieved over the said order dated 16.04.2012, the present Intra-Court Appeal has been filed.
3. Today, when this Writ Appeal is taken up for hearing, the learned counsel appearing for the respondents/teachers, on instructions, would submit that during the pendency of this writ appeal, the order passed by the learned Single Judge in the writ Court has been complied with and these two teachers have been paid the advance incentive increment for having acquired the higher qualification by them. Thereby, virtually nothing survives in this writ appeal to be adjudicated.

In view of the said submission made by the learned counsel appearing for the respondents which cannot be controverted by the learned Government Advocate appearing for the appellants by filing any contra documents, accepting the said factual position, we feel that no further adjudication is required in this appeal.
5. Accordingly, by recording the aforestated development, this Writ Appeal is dismissed. There shall be no order as to costs. Consequently, connected miscellaneous petition is also closed.
