Prayer in M.P.(MD)No.1 of 2015 : This Miscellaneous Petition filed under
Section 5 of the Limitation Act, to condone the delay of 2684 days in filing the
petition to set aside the abatement in M.P.(MD)No.1 of 2007 in A.S.
(MD)SR.No.19431 of 2007 on the file of this Court due to the death of the
second respondent.
Prayer in A.S(MD)SR.No.19431 of 2007 : This Appeal Suit filed under
Section 70(2) of Tamil Nadu Hindu Religious and Charitable Endowments Act,
1959 r/w order 41 r/w Section 96(1) of Civil Procedure Code, to call for the
records and set aside the judgment and decree dated 21.04.2004 in O.S.No.
186 of 1993 on the file of the Additional Subordinate Judge, Dindigul, and
allow this appeal with costs.

ORDER
This Miscellaneous Petition has been filed seeking orders to condone the delay of 2684 days in filing the petition to set aside the abatement in M.P. https://www.mhc.tn.gov.in/judis 3 (MD)No.1 of 2007 in A.S.(MD)SR.No.19431 of 2007 caused due to the death of the second respondent.
2. When the matter is taken up for hearing today, the learned counsel for the petitioner submitted that the parties have not turned up and they have not complied with the orders of this Court dated 01.09.2022. Hence, this petition is dismissed. Consequently, A.S.(MD)SR.No.19431 of 2007 stands rejected at the SR stage itself. No costs. M.P.(MD)Nos.1 of 2007 and 2 & 3 of 2015 stand dismissed.
