Learned counsel for the respondent/State submits that appellant No.1 Mehtabsingh S/o Shri Dhanna Lal Lodhi, resident of Village Bhadri, Police Station Chanderi, District Ashoknagar has died on 14.06.2022.
Learned counsel refers to verification report dated 10.02.2023 submitted by S.H.O. Police Station Chanderi, District Ashoknagar wherein it is stated that appellant No.1 Mehtab Singh has died due to snake bite on 14.06.2022. Verification report is enclosed with unnatural death intimation No.40/2022 and death certificate of Mehtab Singh.
None of the relatives of Metabsingh have applied to prosecute the appeal under Section 394 of Cr.P.C.. This appeal was filed assailing the judgment of conviction and sentenced dated 03.10.2005 passed by the Additional Sessions Judge, Mungawali, District Guna in S.T.No.202/2000. Since the appellant No.1 Mehtab Singh has expired the appeal in his reference abates.
The appeal with referenc to the appellant No.2 Karan Singh shall continue.
