A n objection has been raised by the counsel for the respondents with regard to the maintainability of the appeal. It is submitted that the suit filed by Masood Ahmed/respondent No.1 was decreed against which the appellants as well as respondent no.2/Ramdas preferred an appeal. The appeal filed by respondent no.2/Ramdas has been dismissed whereas the appeal filed by the appellants was allowed and the judgment and decree passed against the appellants was set aside. The respondent no.2/Ramdas has not filed any appeal. It is submitted that since the decree was passed in favour of the appellants, therefore, the appeal filed by the appellant is not maintainable.
As none appears for the appellants, therefore, the case is adjourned. List tomorrow (14.03.2023) at the top of the list.
