Shri Abhijeet Shrivastava, learned counsel for the respondents 3 and 4. Shri Seth, learned counsel for the petitioner submits that the case of the petitioner is no more res integra in view of the decision of the Orissa High Court in W.P.(C) No.20463/2018 rendered on 17.4.2019. However, it is informed that this judgment of Orissa High Court is under challenge before the Apex Court in SLP which is likely to be listed on 10.2.2022.

Let the case be taken up in the last week of February, 2022. Meanwhile, counsel for the Revenue may seek instructions and file the reply, if so advised.
