Heard on I.A. No.5581/2021 which is a application for seeking direction to release the certified copies of original documents from the record.
It is submitted that during the pendecny of the first appeal one another civil suit in respect of the disputed property has been filed by one Janakrani against the appellant. The appellant has filed two applications before the Lower Appellate Court under Order 41 Rule 27 of CPC alongwith various certified copies of documents which are attached with original record but the said documents are the non-exhibited certified copies which are essentially required for appellant to defend himself in the Civil Suit No. RCSA/12/2016 pending before JMFC Damoh. With this regard, learned trial Court has given finding in para no.26 of the impugned judgment.
Considering the reasons stated in the application, I.A. No.5581/2021 is allowed. Office is directed to return certified copy of original documents to the appellant on substitution of the same by photocopies as early as possible.
List this case after two weeks for consideration of pending I.A.
