JUDGMENT
~~~~~~~~~ The petitioners are Foreign Medical Graduates (FMG), who have completed their medical course in China. They have cleared NEET Examination and had completed all classes as per course structure in the parent institution. They have also completed compensatory physical classes in parent institution online due to Covid-19. The petitioners have also passed Foreign Medical Graduate Examination (FMGE).
2. The petitioners state that they joined the medical course during 2017-2018 period. Due to Covid-19 pandemic, their classes happened to be in online mode. The 2025:KER:54865 W.P.(C) No.42885/2024 :5: National Medical Commission (NMC) allowed online classes during Covid pandemic period on condition that online classes shall be compensated by physical and practical training in parent institutes. The petitioners therefore travelled back to China and completed their compensatory classes also. Respondents 2 and 3 are now denying registration to the petitioners by mandating a compulsory "Clinical Clerkship Program" in lieu of online classes.
3. The petitioners state that the action of the 2nd respondent-Kerala State Medical Council in delaying the issuance of provisional registration to the petitioners is illegal. The imposition of Clinical Clerkship before issuing provisional registration in Kerala is arbitrary. The NMC does not mandate Clinical Clerkship for FMGs who have compensated for their online classes with physical classes in their parent institutions. Respondents 2 and 3 cannot act against the guidelines issued by the 1st respondent-NMC.

4. The petitioners are bound to complete their internship as per CMRI Regulations within ten years of joining the institute. The refusal of respondents 2 and 3 to allow the petitioners to join internship will render them ineligible.
5. According to the petitioners, this Court in the judgment in Leeba Mary Eapen and others v. The Travancore Cochin Council of Modern Medicine and others (W.P.(C) No.2344/2020) has directed the then Medical Council to issue provisional registration to the petitioner therein since all adequate qualifications were met. This Court held that the resolutions of the State Medical Councils cannot be in contradiction to the existing rules and regulations of the NMC regarding FMGs.
6. In Travancore Cochin Council of Modern Medicine v. Leeba Mary Eapen and others (W.A. No.1667/2020), a Division Bench of this Court held that the fundamental right of medical graduate to practice medical profession cannot be violated by issuing Circulars or 2025:KER:54865 W.P.(C) No.42885/2024 :7: Notifications by the State Medical Councils. By Ext.P37 judgment, the Hon'ble High Court of Himachal Pradesh has recorded that the Himachal Pradesh State Council did not insist on Clerkship. The petitioners prayed to command respondents 2 and 3 to process the provisional registration application of the petitioners within a reasonable time.
7. The 2nd respondent-Kerala State Medical Council filed a statement. The 2nd respondent submitted that the claim of the petitioners that they had compensated the online classes undergone by them by attending compensatory physical classes cannot be accepted as genuine. The Council of Modern Medicine has constituted a Scrutiny Committee and every application of FMGs for registration are considered on its merits with the aid of supporting documents.

The 2nd respondent-Council has taken a decision on 19.09.2024 holding that medical students, who had a course break during Covid-19 period and who had to undergo online classes due to it, will have to undergo one year Clinical 2025:KER:54865 W.P.(C) No.42885/2024 :8: Clerkship before joining for the one year CRMI.
9. A large number of FMGs from India like the petitioners had a course break for nearly three years out of their five year course due to Covid-19. They were deprived of the on-hand clinical / practical training during the period. Permitting them to practice medicine in the society without equipping them with sufficient compensatory practical / clinical training will not be in public interest. It is in such circumstances that Annexure- R2(a) resolution was passed holding that medical students, who had a course break during Covid-19 period and for the reason had to undergo online classes, have to undergo one year Clinical Clerkship and thereafter to undergo one year CRMI, subject to the decision of the 1st respondent-Commission.
10. I have heard the learned counsel for the petitioner, the respective learned Standing Counsel appearing for respondents 1 and 2 and the learned Government Pleader representing the 3rd respondent.

11. The petitioners are FMGs, who have joined their medical course in China during the 2017-2018 period. The Foreign Medical Graduates were governed by Screening Test Regulations, 2002 and the Eligibility Certificate Regulations, 2002 during that time. At present, the FMGs are regulated by the Foreign Medical Graduate Licentiate Regulations, 2021. Due to Covid-19 pandemic, the petitioners had to return back to India. But, their classes continued in online mode. The 1st respondent-NMC mandated that the online classes should be compensated with adequate physical classes.

Ext.P6 FAQ published by the NMC states that Foreign Medical Graduates are allowed to undergo online classes of theory subjects only and supplemented by offline practical and clinical training done in the Medical University and its affiliated hospitals during the course of MBBS. Ext.P7 Circular issued by the NMC states that the FMGI Regulations, 2021 shall not be applicable to candidates who have joined their undergraduate medical education in foreign institutions prior to 2025:KER:54865 W.P.(C) No.42885/2024 : 10 : 18.11.2021.

As per Ext.P7 Guidelines issued by the NMC, Indian citizens, who are Foreign Medical Graduates, shall be required to complete CRMI in India if they have not undergone such practical training after obtaining such qualifications as may be required by the Rules and Regulations in force in the country granting such qualifications or has not undergone any practical training in the country.

On 28.07.2022, the NMC had issued a public notice allowing the students, who were in final year during Covid-19 / War etc. and who obtained course completion certificate before 30.06.2022, to appear for FMG Examinations and subsequently undergo two years CRMI so that the classes attended online can be compensated with physical training. Evidently, the petitioners do not fall under the ambit of Ext.P9. This is evident from Ext.P10 FAQ also.
15. The 2nd respondent has, however, declined to grant provisional registration to the petitioners based on 2025:KER:54865 W.P.(C) No.42885/2024 : 11 : Ext.R2(a) resolution. In Ext.R2(a) resolution, the Kerala State Medical Councils decided that students of those Batches, who have returned to their foreign institutions after the break and rejoined the course and have completed offline internship, such students should be given one year Clinical Clerkship in order to make good, compensation / clinical training / practical training before permitting them to do the one year CRMI. Ext.R2(a) resolution would show that the said resolution has been passed subject to the decision of the NMC.

The 1st respondent-NMC, in their statement dated 17.01.2025, has stated that the crucial aspect to be considered is whether the petitioners have undergone any portion of their studies through online mode. The physical presence of the petitioners at foreign state is immaterial. If the classes were conducted through online mode, they need to undergo CRMI for a period of two years. A student may be exempted from two year internship and instead complete a one year CRMI if he has adequately compensated by the online 2025:KER:54865 W.P.(C) No.42885/2024 : 12 : classes by subsequently attending them in an offline mode. The NMC has also taken a stand that State Medical Councils are supposed to assess the eligibility of the applicants independently.
17. It is the specific case of the petitioners herein that they had travelled back to China and completed their compensatory classes. If they have completed the compensatory classes, then the 2nd respondent cannot take a stand that the petitioners have to undergo a two year Clinical Clerkship. Going by the statement made by the 1st respondent- NMC, the petitioners are entitled to exemption from two year internship and they need to complete only one year CRMI since they have adequately compensated for the online classes by subsequently attending in an offline mode. The 2nd respondent in such circumstances will not be justified in imposing a two year Clinical Clerkship upon the petitioners even though the State Medical Councils are competent to assess the eligibility of the petitioners independently.

18. The petitioners are therefore entitled to relief. It is declared that "Clinical Clerkship" is not required for the petitioners as they have compensated their online classes with physical classes in their parent institutions as directed by the 1st respondent. Respondents 2 and 3 are directed to process the registration application of the petitioners and pass appropriate orders / take appropriate decision within a period of six weeks.
The writ petition is disposed of as above.
