ORDER
This bail application is filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS').
2. Petitioner is the accused in Crime No.501/2025 of Kuttipuram Police Station, Malappuram District; registered for the offences punishable under Sections 318(4) and 316(2) of the Bharatiya Nyaya Sanhita, 2023.
3. The prosecution case is that, petitioner had collected an amount of Rs.2,00,000/- during the period from 02.06.2023 to 01.11.2023 promising to secure employment for the defacto complainant in Manchester, UK and thereafter failed to provide such an employment, and thereby committed the offences alleged. Petitioner's arrest was recorded on 06.06.2025 and she has been in custody since then.
4. I have heard Adv.Ipsita Ojal, the learned counsel for the petitioner as well as Sri.Noushad K.A., the learned Public Prosecutor.
5. A reading of the FIR indicates that information regarding the crime was received at the Police Station on 07.05.2025. However, petitioner's arrest was recorded only on 06.06.2025, though she was taken into BAIL APPL. NO. 8595 OF 2025 3 2025:KER:52925 custody in connection with other crimes on 02.05.2025, even before the information was given regarding the present crime. Despite the above, her arrest regarding in the present crime was recorded only on 06.06.2025. This Court has already granted bail to the petitioner in three other crimes, considering the period of detention already undergone by her.

Since the arrest in the present crime has been recorded on 06.06.2025 and in effect she has been in custody from 02.05.2025, I am of the view that further detention of the petitioner is not necessary. Though the learned Public Prosecutor submitted that petitioner is involved in 13 other cases, since all of them are of similar nature, the continued detention of the petitioner is not necessary.
7. In the result, this application is allowed on the following conditions:-
(a) Petitioner shall be released on bail on her executing a bond for Rs.50,000/- (Rupees fifty thousand only) with two solvent sureties each for the like sum to the satisfaction of the court having jurisdiction.
(b) Petitioner shall appear before the Investigating Officer as and when required.
(c) Petitioner shall not intimidate or attempt to influence the witnesses; nor shall she tamper with the evidence.
(d) Petitioner shall not commit any similar offences while she is on bail.
(e) Petitioner shall not leave India without the permission of the Court having jurisdiction.

NO. 8595 OF 2025 4 2025:KER:52925 In case of violation of any of the above conditions, or for modification or deletion of any of the conditions, the jurisdictional Court shall be empowered to consider such applications, if any, and pass appropriate orders in accordance with the law, notwithstanding the bail having been granted by this Court.
