                              JUDGMENT

[WP(C) Nos.39556/2024, 38672/2024, 38691/2024 & 38703/2024] In all these cases, the petitioners are Educational Institutions offering various undergraduate and postgraduate courses, and affiliated with the 2nd respondent University. The petitioners have submitted applications for affiliation for certain new courses for the academic year 2024-2025 and such applications were submitted during the academic 2023-24, within the time prescribed by the University.

The University, after considering the same, issued Ext.P5 order dated 28.05.2024 in W.P(C) No.38672/2024 ( which is Ext.P3 in W.P(C) No. 38703/2024, Ext.P2 in W.P(C) No.39556/2024 and Ext.P3 in W.P(C) No.38691/2024) instructing the petitioner colleges to obtain Administrative Sanction/No Objection Certificate from the Government for processing 2024:KER:84904 WP(C) NO. 39556 OF 2024 n conn.cases 10 application for affiliation. Accordingly, the petitioners have approached the Government and obtained the same by a common order on 20.06.2024, which is Ext.P5 in WP(C) 38691/2024. Later, NOCs were issued by the Government on various dates to these colleges. Thereafter, as part of the processing the applications for affiliation submitted by the petitioners, the University conducted an inspection in the colleges on various dates and except in the case of the petitioner in W.P(C) No.39556/2024, the applications are under process. As far as the petitioner in W.P(C) No.39556/2024 is concerned, affiliation is already granted on 06.09.2024.

3. In the meantime, anticipating the affiliation, the petitioners have admitted students from the list of persons registered under Common Allotment Process (CAP) of the University. However, so far, those students have not been permitted to be registered with the University because, the affiliation of petitioner colleges is not granted. As far as the petitioner institution in W.P(C) 2024:KER:84904 WP(C) NO. 39556 OF 2024 n conn.cases 11 No.39556/2024 is concerned, the non-registration was in view of the fact that the affiliation was granted on the last date of closing the admission process. It was in these circumstances these writ petitions were filed by the petitioners, seeking a direction to the respondent University to grant affiliation to the respective courses and also permit the students to register for the first semester examination and appear in the examinations which are commencing on 20.11.2024.

4. Statements were filed by the learned Standing Counsel for the respondent University, opposing the reliefs sought in these writ petitions. It was pointed out that, none of the provisions in Kannur University Act or the Kannur University First Statutes 1998, enable the petitioner institutions to admit students without obtaining affiliation. On the contrary, there is a specific prohibition contemplated as per Statue 19 (c) of First Statute 1998 in Chapter V, against the admission of students without obtaining affiliation.

2024:KER:84904 WP(C) NO. 39556 OF 2024 n conn.cases 12 Therefore, it was pointed out that, as far as the courses for which affiliation is sought by the petitioners are concerned, the last date of admission was 06.09.2024, and as of that date, they did not have affiliation.

5. Heard Sri.K.B. Gangesh, learned Counsel for the petitioners, Sri.V. Venugopal, learned Government Pleader for State and Sri.I.V. Promod, learned Standing Counsel for the University.

The question that arises for consideration is whether the petitioners are entitled to affiliation for the academic year 2024- 2025 and to conduct courses for which affiliation is sought from this academic year onwards. Along with the main prayers they also sought interim orders, permitting the students already admitted by them, in anticipation of getting affiliation, to register for the first semester examination commencing on 20.11.2024 and to attend the said examination. The learned Counsel for the petitioners pointed out that, even though an application for affiliation was submitted in 2024:KER:84904 WP(C) NO. 39556 OF 2024 n conn.cases 13 time, which was to be considered by the University within a time frame stipulated in the Kannur University First Statutes, 1998 particularly, by the provisions in Statute 4 and 6. It was pointed out that as per Statute 6(1) in Chapter V, the application, which was supposed to be submitted on or before 31st of December of the previous academic year, was to be considered by the Syndicate not later than 30th of April of the preceding academic year in which the colleges/courses are proposed to be started. Thus, according to the learned Counsel for the petitioners, the University did not follow the time line despite the fact that it was a statutory obligation upon the University to comply with the same. Therefore, there were lapses on the part of the University as well, which resulted in delay in getting the completion of the procedure relating to the grant of affiliation.

7. The learned Standing Counsel, on the other hand, contended that, by virtue of various provisions contained in the 2024:KER:84904 WP(C) NO. 39556 OF 2024 n conn.cases 14 Statute, the petitioners are not empowered to admit any students in anticipation of affiliation.

8. I have carefully gone through the records and heard the contentions raised on both sides.

9. Of course, it is to be noted that in all these cases the applications were submitted in time. However, despite the fact that a statutory timeline has been prescribed, as per Statue 6 of Kannur University First Statues 1998, which compels the University to consider the application for affiliation on or before 30 th of April of the preceding academic year, for which the affiliation is sought, the same is not seen complied with. Ext.P3 in WP(C) 38691/2024 would indicate that, the colleges were instructed to obtain administrative sanction only on 28.05.2024 and the processing was commenced after the colleges obtained the administrative Sanction on 20.06.2024 an the receipt of NOC on the subsequent dates. Thus, even though going by the statutory scheme contemplated in the 2024:KER:84904 WP(C) NO. 39556 OF 2024 n conn.cases 15 Kannur University First Statues 1998, the University was supposed to consider the application for affiliation by completing process of affiliation before commencement of the academic year, there is delay on the part of the University in completing the procedure.

10. Now in W.P(C) No.39556/2024, the affiliation is already granted on 06.09.2024. With regard to the other petitioners, the process of affiliation is even now going on, even though inspections in this regard are already conducted. Since the timeline is statutorily fixed, it was the bounden duty of the University to abide by the same. Therefore, some directions are to be issued to the University for considering the question of granting affiliation to the petitioners in W.P(C) Nos.38703/2024, 38672/2024 and 38691/2024 without any further delay.

Another crucial issue that arises for consideration, which is incidental to the main issue of granting affiliation, is the registration of students who had already secured admission to the 2024:KER:84904 WP(C) NO. 39556 OF 2024 n conn.cases 16 petitioner colleges. It is reported that around 100 students have already been admitted to all four institutions for the courses which are the subject matter of these writ petitions. As mentioned above, they are not registered by the University in view of the fact that they were admitted by the colleges without getting an affiliation at the last date of registering the students, which is already over by 06.09.2024.

While considering this issue, the crucial aspect to be noticed is that, the Statute 19(c) of Kannur University First Statute, 1998, specifically contemplates that no students shall be admitted to any course of instruction in the college in anticipation of affiliation. However, it is also a fact that, the petitioner institutions have admitted students in anticipation of the affiliations, and they are already undergoing the courses. Therefore, evidently, the petitioners have violated the statutory provisions. The learned Counsel for the petitioners sought to justify the stand taken by them, 2024:KER:84904 WP(C) NO. 39556 OF 2024 n conn.cases 17 by producing documents in W.P(C) No.38691/2024 to show that during the previous year also, the petitioners therein have admitted students in respect of a new course commenced in that academic year, in anticipation of the affiliation and they were permitted to be registered. Ext.P8 to P17 in W.P(C) No.38691/2024 are the documents produced by the petitioners to substantiate the same. However, the learned Standing Counsel for the University, in response to the same submitted after getting instructions from the University that, in that year, the last date of admission was extended till 12.11.2023, whereas the petitioner college therein was granted affiliation on 21.09.2023, which was much before the last date of registration. It was pointed out that the situation that prevailed last year is not in existence this year; therefore, the said documents are not relevant at all.

13. I find force in the said submission of the learned Standing Counsel. Even otherwise, even if the admissions made 2024:KER:84904 WP(C) NO. 39556 OF 2024 n conn.cases 18 during the last year in anticipation of the affiliation were regularized subsequently, that by itself cannot be a justification on the part of the petitioners to seek the same relief this year, and to cover up the mistakes they have already committed.

However, even while considering the same, one of the crucial aspects to be noticed is that, even though the Statute 19(c) contemplates that no students shall be admitted to any course of instruction in the college in anticipation of affiliation, the consequences for violating the same are not specifically mentioned in any of the said Statues. Therefore, this would indicate that, upon getting affiliation, it is possible for the University to regularize such admission, even if there is a violation of the said provision, taking note of the factual circumstances existing in the case. To be precise, nothing precludes the University from considering the question of regularization of approval of admissions already made in violation of Statute 19(c) on the affiliation being granted to the respective 2024:KER:84904 WP(C) NO. 39556 OF 2024 n conn.cases 19 institutions in this regard.

In such circumstances, I am of the view that, as the consideration of the application submitted by the petitioners in time got delayed beyond the statutory timeline prescribed in this regard, the University has to be directed to complete the process of considering the application and to take a decision thereon. Therefore, there shall be a direction to the respondent University, to take appropriate decisions on the applications submitted by the petitioners in W.P(C) Nos.38703/2024, 38672/2024 and 38691/2024, within a period of two months from the date of receipt of a copy of this judgment. As far as the regularization of admission of the students already admitted by these institutions are concerned, I am of the view that, even though the said admissions were made by the petitioner institutions in violation of Statute 19(c) of the Kannur University First Statute 1998, the fate of the students who were already granted admission, and pursuing the course are to be 2024:KER:84904 WP(C) NO. 39556 OF 2024 n conn.cases 20 taken into consideration, by considering the principles of equity. The denial or delay in affiliation was not because of their fault and they might have secured admission on the bonafide belief that, the are admitted to a course affiliated to the University. It is also a fact to be noticed in this regard that, the petitioner institutions are already affiliated to the University in respect some other courses, and therefore, the possibility of an impression being created in the minds of the students and their parents, as to the proper recognition/affiliation of the course they joined, are much higher. Therefore, non-regularization of their admission, would cause serious injustice to them.

16. Of course, it is true that, the petitioners were at fault by granting admission, but for the said purpose, the students who got admissions, need not be penalized. Therefore, in case the University takes a decision in favour of the colleges as far as the affiliations of the courses are concerned, the University shall regularize the 2024:KER:84904 WP(C) NO. 39556 OF 2024 n conn.cases 21 admissions already granted by the petitioner institutions by registering the students. This is particularly because, it is seen from Ext.P17 in W.P(C) No.38691/2024 that, during the academic year i.e., 2023-24, even though the last date of admission was on 12.11.2024, the registration of the students of the petitioner therein was effected on 09.01.2024. Therefore, as mentioned above, it is possible for the University to register the students in certain circumstances, and the University permitted registration of the students thereafter.

Thus, in the peculiar facts and circumstances of the case, I am of the view that, this writ petition can be disposed of with the following directions.

i The applications for affiliation submitted by the petitioners in WP(C) Nos 38691/2024, 38672/2024 and 38703/2024, shall be disposed of by issuing final orders on affiliation, within a period of two months from the date of receipt of copy of this 2024:KER:84904 WP(C) NO. 39556 OF 2024 n conn.cases 22 judgment, ii In case such affiliations are granted, the admission of the students already granted by the petitioners are to be regularized in view of the reasons mentioned above by permitting them register with the University and attending the exams. However, it is clarified that, this order will not preclude the University from initiating appropriate proceedings against the petitioner institutions for granting admission in violation of the statutory provisions. iii As far as the petitioner in W.P(C) No.39556/2024 is concerned, as the affiliation is already granted on 06.09.2024, which was incidentally the last date of registration for the students, those students are to be registered by the University forthwith.
