ORDER
Petitioner is the accused in Crime No. 199 of 2009 of Panangad Police Station, Ernakulam now pending as L.P.No.37/2017 on the files of the Judicial First Class Magistrate's Court-VIII, Ernakulam. Since a non-bailable warrant is pending against him. He seeks for a direction for consideration of this applications for recall of warrant and for bail on the date of summons itself.
2. Having heard the learned counsel for the petitioner as well as the learned Public Prosecutor, I am of the view that this Crl.M.C. can be disposed of with a direction.
3. Though the petitioner contends that summons was not served, I am of the view that since he has expressed his willingness to appear before the Court and participate in the trial, the relief sought for in this Crl.M.C can be considered.
4. Accordingly, if the petitioner appears before the learned Magistrate within 15 days from today and apply for the grant of bail and recall of a warrant, the same shall be considered on the day of appearance itself.

5. To enable the petitioner to appear as directed, the non- bailable warrant issued against him shall be kept in abeyance for a period of 15 days from today.
