Writ petition (civil) praying inter alia that in the circumstances
stated in the affidavit filed along with the WP(C) the High Court be
pleased to direct the respondents 1 to 3 to permit the petitioners to
appear for the 7th semester examination,by remitting the fee as stipulated
in Ext.P2, subject to the outcome of R.P.Nos.433 and 436 of 2024 in
W.A.Nos.926 and 1120 of 2022, pending on the file of this Hon'ble Court,
pending final disposal of the Writ Petition(C).
This petition coming on for admission upon perusing the petition and
the affidavit filed in support of WP(C) and upon hearing the arguments of
M/S BABU JOSEPH KURUVATHAZHA, ARCHANA K.S., MOHAMMED SHAFI.K, NOEL EALIAS,
Advocates for the petitioners, the court passed the following:

======================== WP(C)No.16066 of 2024 ======================== Dated this the 25th day of April, 2024 ORDER The learned counsel for the petitioners insist for an interim order to permit the petitioners to appear for the final semester examination without paying the semester fees for the General Category. Eventhough, a judgment in favour of the petitioners had been passed as per Ext.P10, the same was set aside by a Division Bench of this Court as per Ext.P11 judgment. It is the case of the petitioners that, as the petitioners had already filed review petitions against Ext.P11, which is pending consideration. However, as long as Ext.P11 judgment is in force, any interim order permitting the petitioners to appear for the examination without paying the necessary fees will be against the said order. Therefore, I am not inclined to pass an interim order. Therefore, the prayer for interim order is rejected.
