MEMORANDUM OF AGREEMENT UNDER SECTION 89 OF THE
CODE OF CIVIL PROCEDURE READ WITH RULES <4 & 25 OF
THE CIVIL PROCEDURE (ALTERNATIVE DISPUTE E RESOLUTION)
RULES . 2008
The parties Nave agreed ta settle the dispute between them
under the fallawing terms and conditions
1. The petitioner hereby agree that an extent of 1O cents of land
forming part of 26 cents of preperty in Sy No, 2°7/l of Palakusha
Village, Muvattupusha Taluk , more clearly deserbed in this sketch
annexed fo this agreement shall be assigned in favour of the 3°
resoondent free of cost. S is in consideration of the loss suffered
by the 3° respondent on account of the mining of the land which
fed ta the Exhibit 88 order,
é. the expenses for executing the sale deed shall be met by the
3° respondent,
3. tn execution of the sale dead as mentioned above, the entire
disputes sending befbween the parties shall stand setthed fully and
finally and that the 3 respandent agrees that he wil nat make
any further claim against the petitioner in the above regard.
4, The 3° respandent agrees to withdraw the petition dated
30.7. 2012 submitted before the District Office , Mining anc Geology
Department, Ernakulam against the petitioner which has resulted
