JUDGMENT
[WP(C) Nos.14115/2024, 25908/2023, 12590/2024, 14195/2024] Among these four Writ Petitions, WP(C)Nos.14115/2024, 12590/2024 and 14195/2024 have been filed by the petitioners -
who are 'brothers', who claim rights over certain properties which, they say, were obtained from their father through Settlement Deeds.

As far as WP(C)No.25908/2023 is concerned, it has been filed by Smt.Bharathy, who also impels right over the above said properties, asserting that she has been subjected to threat and intimidation by the petitioners in the other cases (who will hereinafter referred to as ''brothers'' collectively).

Coming back to the Writ Petitions filed by the 'brothers', their learned counsel - Sri.Akhil Vijay and Sri.Bala Prasannan, assert that Smt.Bharthy is obstructing their clients and employees from entering into their properties and are threatening them with dare consequences, if they are to cut and remove rubber trees standing therein, even though they are enjoying orders of injunctions against her from the competent Civil Courts. They WPC 14115/24 & connected 10 maintain that there are no subsisting civil disputes with respect to the title of the properties in question and that such have already been settled through judgments of the competent Civil Courts, produced as exhibits in the Writ Petitions filed by them. They say that, therefore, their clients were constrained to approach the Station House Officer, Mundakkayam, with a request for protection;
but that it has been denied to them, thus constraining them to approach this Court through these Writ Petitions.
4. While so, as I have already said above, Smt.Bharathy has approached this Court seeking a direction that the 'brothers' be not allowed to cut and remove trees from the properties in question and that she be given adequate and effective protection for her life and property.

Sri.Mohammed Hussain appearing for respondents 3 to 6 in WP(C)No.12590/2024, conceded that the 3rd respondent is Smt.Bharathy - the petitioner in WP(C)No.25908/2023; and that, as said above, she is only asserting her legal right over the property, without causing any threat or intimidation to the petitioners-
'brothers'. He added that the other respondents are relatives of WPC 14115/24 & connected 11 Smt.Bharathy and that they have also not committed any action in violation of law. He concluded saying that the attempt of the 'brothers' is to grab the properties and to illegally cut and remove trees therefrom, which his client is entitled to contest under the civil processes, which she is pursuing, having filed necessary applications before the competent Civil Courts.

Sri.P.M.Shameer - learned Government Pleader, in response to the rival contentions projected as afore by the learned counsel for the various Writ Petitioners, submitted that the Police are maintaining vigil to ensure that the internecine disputes between the parties do not degenerate into breach of peace. He added that the Police cannot intervene in the question whether either of the parties have the right to cut and remove rubber trees from the properties in question; and pointed out that, even going by the orders of injunctions obtained by the ''brothers'', Smt.Bharathy has only been restrained from entering into the properties and causing any waste thereon. He submitted that, therefore, until and unless the competent Civil Court takes a final decision in this regard, Police can do nothing more than to WPC 14115/24 & connected 12 maintain law and order and to ensure that the parties do not attack each other.

I have no doubt that the afore stand of the Police is the most apposite in the given circumstances because, there is hardly any document on record to show that either of the parties have been allowed to cut and remove rubber trees from the properties they claim. The assertions of the ''brothers'' that they are the exclusive owners of the properties in question, are equally and vehemently refuted by Smt.Bharathy, who claims such right over it.
8. That said, however, the 'brothers' have certainly obtained orders of injunctions against Smt.Bharathy, which appears to be in force even now.
In the afore circumstances, I allow these Writ Petitions, without entering into the question as to who among the parties are entitled to cut and remove trees standing in the property; with a direction to the Station House Officer, Mundakkayam, to ensure that all their lives are sufficiently protected from threats against each other and that law and order is always maintained in the WPC 14115/24 & connected 13 area, without any breach being committed by either of them.
As far as the parties are concerned, their remedies before the Civil Courts are fully left open; and should they obtain orders with respect to the trees, they would be at full liberty to approach the Station House Officer, Mundakkayam with an appropriate representation; in which event, necessary action thereon will be taken, subject to law and within the parameters of the applicable Statutory Scheme.
